Terms of Use

These are the rules for using Playnix. They are short, written in plain English, and they are a real contract — using the site means you accept them.

1. Accepting these terms

By accessing or using Playnix (the "Service") you agree to these Terms of Use. If you do not agree with them, please do not use the Service. These terms work together with our privacy policy and DMCA policy, which are incorporated by reference.

If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian, who accepts these terms on your behalf.

2. What the Service is

Playnix is a free, ad-supported directory and player for browser games. We do not develop the games. Games are supplied by their developers and by HTML5 game distribution partners, and are loaded into our pages from those parties' servers under licence.

No account is required and none is offered. The Service is provided free of charge; we fund it through advertising. We may add, change, remove or suspend any part of the Service, including individual games, at any time and without notice — usually because a licence ended or a game stopped working.

3. Acceptable use

You may play the games, share links to them, and enjoy yourself. You may not:

  • Scrape, crawl, spider, harvest or bulk-download the Service or its data, other than by well-behaved search engine crawlers obeying our robots.txt.
  • Copy, mirror, frame, rehost or redistribute the games, the game listings, our written descriptions or any other part of the Service.
  • Reverse engineer, decompile or attempt to extract the source code of any game, or circumvent any technical restriction, licence check or advertising mechanism.
  • Interfere with the Service: denial-of-service attacks, automated request floods, probing for vulnerabilities, or attempting to gain unauthorised access to any system.
  • Manipulate scores, leaderboards, play counts or any other metric by automated or deceptive means.
  • Use the Service for anything unlawful, or in breach of any law that applies to you.
  • Introduce malware, or use the Service to distribute malware, spam or phishing content.
  • Remove, obscure or alter any copyright notice, attribution, branding or advertising.

Using an ad blocker is your choice and we will not lock you out for it — but please note that the Service exists only because advertising pays for it.

4. Intellectual property

The games

Every game on Playnix is the property of its developer or rights holder. Games are made available here under licences granted through our distribution partners. All rights in game content — code, artwork, audio, characters, titles and trade marks — remain with those owners. Nothing on this site transfers any right in a game to you. You get a personal, non-exclusive, non-transferable, revocable permission to play the games here, for your own non-commercial entertainment, and nothing more.

If you own rights in a game and believe it is being made available here without authorisation, please use our DMCA and takedown procedure. We act on valid notices quickly.

Our material

The Playnix name, logo, site design, category structure, editorial descriptions, guides and the compilation and arrangement of the catalogue are ours, and are protected by copyright and trade mark law. You may link to any page on the site freely. You may not reproduce our written content or present the Service as your own.

5. Third-party content and links

The Service embeds games from third parties, displays advertising sold by third parties, and links to external sites. We do not control that content and we do not endorse it. Your dealings with any third party — including any advertiser — are between you and them. We are not responsible for their content, their privacy practices or any loss arising from them.

If an advertisement on Playnix is misleading, malicious or inappropriate, tell us at miguelmonteracharger@gmail.com and we will block it.

6. Availability

We aim to keep the Service up, but we do not promise it will be available, uninterrupted, error-free or compatible with your device. Games depend on third-party servers we do not operate. Individual games may disappear when a licence lapses. There is no service level commitment, and none can be inferred from these terms.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory. To the fullest extent permitted by law we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be secure, accurate, or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits your rights as a consumer where those rights cannot lawfully be limited.

8. Limitation of liability

To the fullest extent permitted by law, Playnix, its operator and anyone working with them will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or business, arising out of or connected with your use of (or inability to use) the Service — whether the claim is in contract, tort, negligence, strict liability or any other legal theory, and even if we have been advised such damages are possible.

Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims is limited to the greater of the amount you have paid us in the twelve months before the claim (which for a free service is normally nothing) or USD 100.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

9. Indemnity

You agree to indemnify and hold harmless Playnix and its operator against any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Service, or your violation of any law or third-party right.

10. Termination

We may restrict, suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these terms or are harming the Service or other users. Because there are no accounts, this normally means technical blocking. You may stop using the Service at any time — that is your side of the termination right, and it takes effect the moment you close the tab.

Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive it.

11. Changes to these terms

We may update these terms. The "last updated" date at the top of this page always reflects the current version, and material changes will be flagged on the site. Continuing to use the Service after a change means you accept the revised terms.

12. Governing law and general provisions

These terms are governed by the laws of the country in which the operator of Playnix is established, without regard to its conflict of law rules, and the courts of that country have exclusive jurisdiction over any dispute — except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in your own country of residence. Email us at the address below if you need the operator's place of establishment confirmed in writing.

If any provision of these terms is held unenforceable, the rest stays in force and the unenforceable part is narrowed to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Service. You may not assign your rights under them; we may assign ours in connection with a transfer of the Service.
